These Terms of Service ("Terms") govern your access to and use of the SkiBum website at skibumapp.com and the SkiBum mobile application (the "Service") operated by SkiBum, Inc. ("SkiBum," "we," "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract. If you are under 18, you represent that you have parental or guardian consent.
You retain ownership of reviews, photos, and other content you submit ("User Content"). You grant SkiBum a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute User Content solely to operate, promote, and improve the Service.
You represent that you have all rights necessary to submit User Content and that it does not violate any third-party rights or applicable law.

SkiBum provides informational content only. Trail maps, difficulty ratings, run status, and user reviews may be inaccurate, incomplete, or outdated. Conditions on the mountain change rapidly. You are solely responsible for your safety and for obeying resort rules, signage, and ski patrol instructions. Never ski terrain beyond your ability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKIBUM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON USER CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
We may suspend or terminate your account if you violate these Terms or if required for security or legal reasons. You may stop using the Service at any time. Provisions that by nature should survive termination will survive.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Colorado, unless otherwise required by applicable consumer protection law.
We may modify these Terms. We will post updated Terms on this page. Material changes may be communicated via email or in-app notice. Continued use after the effective date constitutes acceptance.
